📜 Terms and Conditions (T&Cs)

1. Scope

These Terms and Conditions apply to all contracts concluded via the website Luxalio between the customer and us as the operator. Any deviating conditions of the customer shall not be accepted unless we have expressly agreed to them in writing.

3. Conclusion of Contract

The products presented on our website do not constitute a legally binding offer, but rather an invitation to place an order.

By clicking the “Order” button, you submit a binding offer to purchase the items contained in your shopping cart. The contract is concluded once we confirm your order or dispatch the goods.

4. Prices and Payment Terms

All prices are stated in Euros (€) and include applicable statutory value-added tax (VAT).

The customer is only entitled to set-off or retention rights if the counterclaim has been legally established or is undisputed.

5. Shipping and Delivery Terms

Delivery is made within Germany to the address provided by the customer.

6. Right of Withdrawal

Consumers have a statutory right of withdrawal. Detailed information and a model withdrawal form can be found in our cancellation policy. Business customers do not have a voluntary right of withdrawal.

7. Retention of Title

The goods remain our property until full payment has been received.

8. Warranty

Statutory liability for defects applies.

For used goods, the warranty period is 12 months for business customers. For consumers, the statutory warranty period of 24 months applies.

9. Liability

We are fully liable in cases of intent and gross negligence. In cases of slight negligence, we are only liable for breaches of essential contractual obligations (so-called “cardinal obligations”) and only for foreseeable, contract-typical damages.

11. Governing Law and Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction shall be the registered office of Luxalio.

12. Final Provisions

If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.

The place of performance shall – where legally permitted – be the registered office of Luxalio.
